Il Fornitore si rende altresì responsabile dei versamenti contributivi relativi al proprio personale, cosi come d'ogni copertura assicurativa e previdenziale necessaria e conforme alle normative vigenti in Italia.
2.2 Solidarietà della Loghin - Compensazione dei crediti del Fornitore
Le parti convengono che l'eventuale inadempimento degli obblighi relativi:
a) a pagamento, da parte del Fornitore, delle retribuzioni ai propri dipendenti, da corrispondersi ai livelli previsti dalle normative vigenti;
b) al pagamento dei relativi contributi assicurativi obbligatori,
c) l'osservanza delle disposizioni di legge sulla prevenzione infortuni, da parte del Fornitore, nei con-fronti dei propri dipendenti, cui esecuzione si é obbligato, osservati i criteri di correttezza previsti dal CC.
Le parti stabiliscono che il Fornitore si vincoli a eseguire il contratto di Fornitura mediante l'impeg-no dei migliori materiali richiesti dalle prestazioni alle quali egli si obbliga, e attraverso l'utilizzazione di personale professionalmente adeguato, e quantitativamente sufficiente.
Le parti stabiliscono che il Fornitore si obblighi, con le modalità gestionali di cui sopra, a compiere l'opera, analiticamente indicata nei singoli ordini d'Acquisto, che saranno emessi a favore del Fornitore dalla Loghin, che s'intendono regolato dalle presenti Condizioni Generali Di Fornitura.
Le prestazioni sono eseguite dal Fornitore in piena autonomia gestionale e decisionale, in modo ineccepibile dal punto di vista qualitativo e a regola d'arte, conformemente ai relativi disegni, matematiche, norme e capitolati indicati nell'ordine d'acquisto.
3.1 Documentazione tecnica
La documentazione tecnica che sarà messa a disposizione del Fornitore dalla Loghin dovrà considerarsi parte integrante degli ordini d'acquisto. La documentazione rimarrà di proprietà della Loghin e il Fornitore dovrà renderla integralmente con la chiusura dei lavori.
3.2 Qualità e conformità delle opere
Le prestazioni eseguite sono controllate di volta in volta dalla Loghin, ma il controllo non solleva il Fornitore da responsabilità relative alla qualità e conformità dell'opera commissionata’gli.
Il Fornitore risponde dell'esecuzione carente. Per il resto valgono le prescrizioni del Codice Civile italiano. La garanzia ha una durata di 24 mesi, dalla messa in funzione dell'opera, tuttavia non superiore a 30 mesi dal collaudo delle prestazioni da parte della Loghin.
3.3 Attività di progetto e processo:
Al ricevimento dell'accettazione dell'offerta, il Fornitore preparerà e sottoporrà alla Loghin per le attività di propria competenza, una prima pianificazione dettagliata delle attività di metodo, simulazione, studio d'imbutitura, progettazione, costruzione modelli, fusione, costruzione stampi.
